Acceptable Use Policy

1. Purpose

Tunela is a creative platform for musicians, creators, and hobbyists. This Acceptable Use Policy exists to prevent the technology from being used to harm real people or to commit illegal acts. By using Tunela, you agree to follow these rules.

2. Absolutely Forbidden Uses (Zero Tolerance)

Any of the following results in immediate and permanent termination of the account, without refund, and where applicable, reporting to law enforcement:

  • Content sexualizing minors in any form. Reported to the US National Center for Missing & Exploited Children (NCMEC CyberTipline) and to the relevant Israeli authority. No appeals.
  • Non-consensual deepfakes of real people, including non-consensual intimate imagery or audio.
  • Voice cloning used to commit fraud — including bank fraud, phishing, romance scams, or any form of impersonation-based scam.
  • Content that facilitates violence, terrorism, or other illegal activity.
  • Harassment, stalking, or doxxing of any person.
  • CSAM of any kind — zero tolerance.

5. Voice Likeness Rights

In many jurisdictions, a person’s voice is a protected aspect of their identity under right-of-publicity or personality-rights law. Examples:

  • New York Civil Rights Law §§ 50-51 (unauthorized commercial use of name, portrait, or voice)
  • California Civil Code § 3344 (commercial right of publicity)
  • Tennessee ELVIS Act (Ensuring Likeness Voice and Image Security Act)
  • EU member states’ personality-rights laws, and similar laws in other jurisdictions

You are solely responsible for obtaining any necessary rights before using Tunela to clone, synthesize, or distribute a real person’s voice. These laws apply regardless of what our terms permit.

6. AI Training Data

Tunela does not use your uploads to train its AI models unless you explicitly opt in via a control in your account settings. Opt-in is off by default. This is different from the default behavior of some competing platforms — we believe your audio is your business.

7. Reporting Violations

To report abuse, email support@tunela.ai with:

  • The URL or user account involved, if known
  • A description of the abusive content or behavior
  • Timestamps or other evidence
  • Your contact information

For CSAM or imminent-harm reports, contact us immediately at the email above and also report to the appropriate authority (in the US: NCMEC CyberTipline).

8. DMCA Copyright Policy

Send copyright takedown notices to privacy@tunela.ai. We aim to respond within a reasonable time. Tunela has not yet completed registration of a designated agent with the US Copyright Office under 17 U.S.C. § 512; this section describes our voluntary takedown process.

How to submit a takedown notice

Under 17 U.S.C. § 512(c)(3), a valid DMCA takedown notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, with enough information for us to locate it
  4. Your contact information (address, phone, email)
  5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner

Counter-notice

If your content was removed and you believe the removal was in error or the use was fair, you may submit a counter-notice to the same address. A valid counter-notice must include your signature, identification of the removed material and its location before removal, a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, and your name, address, phone, and consent to the jurisdiction of the US federal court for your district (or Tel Aviv district court if outside the US).

Repeat infringer policy

Accounts that receive three or more valid DMCA takedowns are permanently terminated.

9. Enforcement

Violations may result in a warning, temporary suspension, or permanent termination depending on severity and history. Serious violations (Section 2) result in immediate termination and, where applicable, referral to law enforcement. Unused paid balance is not refunded in enforcement terminations.

10. Appeal Process

If you believe your account was suspended or terminated in error, email support@tunela.ai with your account email and an explanation. Appeals are reviewed within 14 days. Appeals are not available for Section 2 violations.
